Terms of Service

These Terms of Service ("Terms") govern your use of Mate (the "App"), operated by Take Take Take AS ("we", "us", "our").

By creating an account or using the App, you agree to these Terms. If you do not agree, you may not use the App.

2. The Service

Mate is a consumer-facing application available on iOS, Android, and web, providing social and interactive features related to chess, including content sharing and AI-powered analysis and recommendations.

The App is intended for users aged 16 years or older.

3. Eligibility and Accounts

3.1 Eligibility

You must be at least 16 years old to use the App. By creating an account, you confirm that you meet this requirement.

3.2 Account Registration

You must create an account to use Mate. You agree to:

  • Provide accurate and complete information
  • Keep your account credentials secure
  • Be responsible for all activity under your account

3.3 Account Suspension and Termination

We may suspend or terminate your account at any time if:

  • You violate these Terms
  • You misuse the App or harm other users
  • We are required to do so by law

You may stop using the App at any time by discontinuing use or deleting your account.

4. User Content

4.1 Ownership

You retain ownership of the content you upload or share through the App ("User Content"), including text, images, games, and other data.

4.2 License to Us

By uploading or sharing User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, process, and display that content solely for the purpose of operating, improving, and providing the App.

We may use User Content in aggregated or anonymized form for:

  • Improving the service
  • Analytics and research
  • Product development

We do not sell or reuse identifiable User Content for marketing without your consent.

4.3 Responsibility

You are solely responsible for your User Content and confirm that you have the necessary rights to upload and share it.

5. Acceptable Use

You agree not to:

  • Violate laws or regulations
  • Infringe intellectual property or privacy rights
  • Harass, abuse, or harm others
  • Attempt to reverse engineer, disrupt, or misuse the App
  • Use the App in a way that interferes with its normal operation

6. AI-Generated Analysis and Recommendations

The App may provide AI-generated analysis, coaching, or recommendations, including chess evaluations and insights.

You acknowledge and agree that:

  • Such outputs are provided on a best-effort basis
  • They may be inaccurate, incomplete, or incorrect
  • They are not professional, authoritative, or guaranteed
  • You should not rely on them for any serious, critical, or real-world decisions

We make no warranties regarding the accuracy or usefulness of AI-generated outputs.

7. Subscriptions and Payments

7.1 Free and Paid Features

Mate is offered on a freemium basis. Some features require a paid premium subscription.

7.2 Billing

Subscriptions are:

  • Purchased through Apple App Store or Google Play
  • Auto-renewing unless cancelled through the platform
  • Billed according to the pricing shown at purchase

7.3 Refunds

Refunds are handled exclusively by the platform (Apple or Google) and are subject to their respective refund policies. We do not offer separate or additional refunds.

8. Intellectual Property

All rights to the App, including software, design, trademarks, and content (excluding User Content), are owned by Take Take Take AS or its licensors.

You may not copy, modify, distribute, or exploit any part of the App except as permitted by these Terms.

9. Privacy

Our processing of personal data is governed by our Privacy Policy, available at: taketaketake.com/privacy

10. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied.

We do not guarantee that the App will be:

  • Uninterrupted
  • Error-free
  • Secure
  • Fully accurate

11. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount you paid to us in the last 12 months, or zero if you used the free version

Nothing in these Terms limits liability that cannot be excluded under Norwegian law.

12. Changes to the Terms

We may update these Terms from time to time. If changes are material, we will notify you through the App or by other reasonable means.

Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Norway.

Any disputes shall be subject to the courts of Norway, unless mandatory consumer protection rules provide otherwise.
